Litigation over AFFF firefighting foam continues on two separate tracks, and it’s worth understanding the distinction between them as the litigation develops.
Personal-Injury Claims
AFFF personal-injury cases are consolidated in MDL 2873, pending in the District of South Carolina before Judge Richard M. Gergel, with more than 15,000 personal-injury cases pending as of mid-2026. The first individual personal-injury test trial was taken off the calendar and had not been reset as of mid-2026. No global settlement currently covers these personal-injury claims, and new cases continue to be filed.
A Separate Track: Water Contamination Claims
Manufacturers have separately reached multi-billion-dollar settlements resolving water-contamination claims brought by public water systems. Those settlements are distinct from, and do not resolve, the individual personal-injury claims still proceeding in the MDL.
